1. Acceptance of Terms

By accessing or using the MotorCatch website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

2. Our Services

MotorCatch provides a subscription-based platform that aggregates automotive data from various public sources, offering tools such as live feeds, market valuations, and auction sniping to assist users in the car trading market. The data provided is for informational purposes only.

3. User Accounts

To access paid features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscriptions, Payments, and Refunds

Subscriptions: Paid services are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the subscription plan you select.

Auto-Renewal: At the end of each Billing Cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or MotorCatch Ltd cancels it. You may cancel your subscription renewal through your online account management page.

Payments: A valid payment method, including a credit or debit card, is required to process the payment for your subscription. We use a third-party payment processor, Stripe, to handle all payments.

Refund Policy: Under the Consumer Rights Act 2015, you have a 14-day "cooling-off" period to request a refund for your subscription purchase.

However, this right to a refund is waived if you access or use any part of the subscription service during this 14-day period. The service is considered a "redeemed" digital product once used. Examples of use include, but are not limited to: logging in and viewing live feeds, setting an alert, performing a VIN check, or using the auction sniper.

By using the Service after purchase, you acknowledge and agree that you are redeeming the digital product and your right to a refund is lost. After this 14-day period, or once the service has been used, all payments are non-refundable, except as required by law.

5. Acceptable Use Policy

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You agree not to:

• Use any automated system, including "robots," "spiders," or "scrapers," to access the Service for any purpose without our express written permission.
• Attempt to decompile, reverse engineer, or otherwise attempt to obtain the source code of the Service.
• Transmit any worms, viruses, or any code of a destructive nature.
• Resell or otherwise commercially exploit the data or Service provided by MotorCatch without our prior written consent.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of MotorCatch Ltd and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MotorCatch Ltd.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the Service through the end of your current billing period.

8. Disclaimer and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for accuracy, we do not warrant that the data provided is always accurate, complete, or current. Your use of the Service is at your sole risk.

In no event shall MotorCatch Ltd, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
